What Happens Next
Upon receiving a valid notice, we will promptly (typically within 5 business days) remove or disable access to the allegedly infringing material, notify the content creator, and provide them with a copy of your notice.
We take these steps in good faith to comply with the law and respect intellectual property rights. Our removal of content does not constitute an admission of infringement, nor does it represent a legal judgment on the merits of your claim.
Warning: Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorney's fees.
For Content Creators: If Your Content is Removed
If you believe your content was removed by mistake or misidentification, you may file a counter-notification. We strongly encourage you to review whether you have the legal right to use the content and consult with an attorney if uncertain, especially regarding fair use claims.
Requirements for a Counter-Notification
Your counter-notification must include:
Your signature (physical or electronic)
Identification of the removed material and where it appeared before removal
This statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
Your name, address, and telephone number
This statement: "I consent to the jurisdiction of the Federal District Court for [the judicial district in which your address is located], and I will accept service of process from the person who submitted the original DMCA takedown notice or their agent."
Send your counter-notification to the DMCA Agent contact above.
What Happens After Filing
We will forward your counter-notification to the original complainant. If they do not file a court action within 10 business days, we may restore your content. If they file suit, the matter is between you and them.
Warning: Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material was removed by mistake or misidentification may be liable for damages, including costs and attorney's fees.
Repeat Infringer Policy
We maintain records of DMCA notices and counter-notifications. Users with multiple substantiated copyright violations may have their access terminated, including channel membership, app access, or platform suspension. We evaluate each situation individually, considering the number and severity of violations, whether infringement appears intentional, and the user's response.
If you have questions about copyright compliance, reach out before uploading questionable content.
Important Notes
We Don't Pre-Screen Content: In accordance with DMCA safe harbor provisions, we do not proactively monitor user content for copyright issues. We rely on users' representations and copyright owners' notifications.
We Remain Neutral: When processing DMCA notices, we act as a neutral service provider following legal procedures. We do not make legal judgments about disputes and cannot provide legal advice.
US Copyright Law: This policy specifically addresses US copyright compliance under the DMCA.
